Thief tricks 74yo into opening door, accomplice strikes

A MACKAY woman dabbed at her eyes with a tissue as she sat in the dock of the District Court in Mackay.

Tamiera Robyn Poid was being sentenced for her part in the violent home invasion of a 74-year-old Mackay man.

Poid tricked the fellow into opening his door to give her cigarettes on May 17, 2016, before her then-partner, Brett Anthony Yasserie, jumped the senior citizen and ransacked his home.

Defence barrister Ross LoMonaco stressed Poid was not aware the burglary would devolve into violence.

Poid, 21, appeared in the court last Wednesday, pleading guilty to burglary and stealing.

That followed Yasserie's sentence on August 11, 2017 to five years' jail, prosecutor Melissa Wilson told the court.

Ms Wilson said Poid had a record of dishonesty offences.

But she backed the defence's stance on Poid's involvement and noted an early plea.

"She was aware that there was going to be some theft, but she wasn't aware there would be any violence ... ," she said.

Mr LoMonaco, instructed by Legal Aid Queensland, said Poid was getting counselling and kicked an ice habit, which was proven by drug test results.

Poid was described as "remorseful", and Judge Paul Smith later said he believed Poid had "turned a corner".

Mr Smith said it was clear in the "unusual case" there was the "existence of duress".

Poid was sentenced to a year in jail, suspended for a year.
