Sex offender released despite breaching orders five times

A CONVICTED sex offender will be released back into the Rockhampton community despite having breached his supervision order for the fifth time in as many years.

Maxwell Edward Gray, 53, appeared via videolink on Monday in Brisbane Supreme Court where he waited anxiously for Justice Peter Flanagan to determine his immediate future.

The court heard it Gray's penchant for smoking marijuana had seen him continually fall foul of the law since his initial release from prison following a lengthy sentence.

Gray failed random urine tests on February 23 and March 26 before he was eventually arrested on April 1 and sent back to jail.

The court heard Gray pleaded guilty on May 14 in the Rockhampton Magistrates Court to two counts of breaching his 2010 supervision order that stated he must abstain from cannabis and alcohol.

He was sentenced to six months behind bars for each offence.

Justice Flanagan said he was satisfied the 2010 supervision order with its 37 strict conditions was working because it had detected Gray's marijuana use very early on.

He said two psychiatrists had provided reports that stated his last known sexual offending occurred in 1996 and they both deemed his risk of sexual re-offending as low.

Justice Flanagan released Gray from prison on the condition he adhere to the supervision order and live with his partner at an approved Rockhampton address.

Gray hit the headlines in 2013 after he sparked a massive manhunt in Rockhampton after he went missing on day release.

He was found a short time later at a northside address.
