Failed pizza shop robbery getaway driver gets jail

THE man who was the getaway driver for a failed armed robbery at a Toowoomba pizza shop will remain behind bars until August.

Adam Sydney Dutton, 44, was sentenced for his role in the robbery where two men - one who was armed with a knife - stormed into Malla & Sons Pizza and Pasta Shop in Newtown in December 2012 and demanded money.

In Dutton's sentencing at Brisbane District Court on Tuesday, Judge Richard Jones said the shop's owner refused to hand over money and called for help from his son, who was also in the shop.

The men then fled the scene and jumped into Dutton's car, which was parked at the back of the store with the motor running.

But in their haste to get away, Dutton ran a red traffic light and hit another vehicle.

"Thankfully no one in that vehicle was injured although there was significant property damage to both your vehicle and to the other vehicle," Justice Jones said.


During a trial last year, Dutton claimed he did not know the other two men planned to rob the store. The court heard on Tuesday he was staying at a halfway house in Toowoomba at the time.

But in that trial, a jury found him guilty of attempted robbery while armed in company.

Justice Jones also noted that Dutton did not try to flee the accident scene after hitting the other vehicle. Dutton was charged with dangerous driving for the crash and pleaded guilty.

In handing down his sentence, Justice Jones said Dutton had been exploited by the two men.

He also said Dutton had a criminal history in three states.

He has been in jail since November last year and spent 173 days behind bars.

Justice Jones took this time into account and sentenced him to two years jail and set a parole release date of August 6 this year.
