Woman awarded $10,000 over ex's Facebook posts

A BOWEN woman has been awarded $10,000 in a case against her ex-husband for his posts on Facebook.

June Marion Kelly sought $150,000 in damages after her ex-husband, David Levick, made a post on Facebook making accusations against her including that she "commits criminal offences", Brisbanetimes.com.au reported.

"June turned out to be a thieving, lying, money crazed bitch who screwed me out of nearly 3 million rand - may she rot in Hell," Mr Levick wrote.

He also accused her of being a thief and having a mental disorder.

The court did not accept Mr Levicl's defence that he was not liable for the post because it was meant to be set to private.

Magistrate Simon Young's ruling read,  "… Liability depends upon mere communication of the defamatory matter to a third person. The communication may be quite unintentional …".

A later apology, also posted to Facebook, was used as evidence the original post was directed at Ms Kelly.
