PCYC decision in disarray

Maranoa Council's plans to overturn the Rec Centre PCYC proposal are in disarray after getting legal advice the motion carried at last week's council meeting was likely to be invalid.

Solicitor James Nielson at King and Company told Council the motion carried at the Roma meeting on December 14 to continue the current lease for six months and then put the Centre to open tender was "ultra vires" - a legal term meaning "beyond the powers".

The problem is that the motion was passed without a rescission motion overturning the previous motion to give PCYC first refusal and a rescission motion requires five working days notice to debate.

Council has now organised an emergency meeting at 4.30pm tomorrow (Christmas Eve) to debate Cr Jason Bartel's rescission motion and his subsequent motion to extend the lease and put it to open tender.

However the special meeting also has a closed item which puts forward the original proposal to hand the lease to PCYC.

The recommendation by Council officer Tony Klein reads "Council (should) finalise the negotiations with the PCYC for the completion of a lease for a period of three years with an option for three years."

That recommendation notes the current lessees pay a $1 peppercorn rent a year but have not received management fees from Council since 2009.

PCYC have asked Council to contribute half the cost of renting a four-bedroom house for the new manager/police sergeant.

The Council report said there had been "ongoing dialogue between PCYC and existing staff on their retention" however none of the staff at the impromptu meeting held with councillors a day prior to the last council meeting said they had any contact with PCYC over ongoing employment.
