Man who killed mother in crash fails in bid for leniency

A MAN has lost his bid to lower his jail sentence after he caused a crash that killed a Darling Downs mother and left two teenagers in a wheelchair.

In June last year, Donald John Moody was convicted of dangerous operation of a motor vehicle causing death and grievous bodily harm while adversely affected by drugs.

He was driving between Gympie and Agnes Water in December 2012 when he crashed into a car, which had a family of five inside, on Childers Rd near Bundaberg.

Moody had been driving with a cocktail of drugs in his system, including amphetamine, meth, diazepam and THC, which is an element found in marijuana.

Miles mother Sandy Meehan died and two of her teenage children suffered traumatic brain and spinal injuries and are now confined to wheelchairs.

The father, who was driving at the time, suffered severe lacerations which required surgery and a fractured foot.

Mrs Meehan's 12-month old baby, who was also in the car, was not seriously injured.

Moody was sentenced to nine years jail but took this to the Court of Appeal, arguing this sentence was excessive.

But the Court of Appeal today found that Moody was sentenced correctly.
