Man who flashed nine-year-old girl avoids conviction

A 26-YEAR-OLD man who inexplicably flashed his penis at a nine-year-old girl has since been receiving psychological treatment, Toowoomba District Court has been told.

Edward Vipond Little pleaded guilty to exposing a child under 12 to an indecent act arising from an incident in which he had flashed the girl who was helping out in her mother's Drayton store on October 12, last year.

Crown prosecutor Shontelle Petrie told the court Little had no previous history and that the victim did not want to make a victim impact statement.

Ms Petrie said the Crown accepted this was at the lower level of such offences which came before the court but it was serious.

Defence barrister David Jones told the court his client was "deeply embarrassed" by his actions which had not been pre-planned and he hadn't gone to the store to commit the offence which he described as a spontaneous act.

Mr Jones tended a psychologist's report to the court which spoke of the defendant having "gained insight" into the incident and that he felt guilt, shame and remorse for his actions and empathy toward the young victim.

The psychologist found he was of low risk of re-offending.

Judge Alexander Horneman-Wren SC said Little would ordinarily be facing a term of actual imprisonment unless there were "exceptional circumstances" which he found to exist in this case.

Noting Little was "otherwise a person of impeccable character" and accepting the offence was "single, opportunistic and brief", he placed Little on 12 months probation with no conviction recorded.
