Family demands justice over fatal hit and run

A HEARTBROKEN Darling Downs family has hit out after charges were dropped against the man allegedly responsible for their partner's sudden death.

Oakey man Bruce Mitchell was found dead on the side of Hamlyn Rd in Oakey in the early hours of November 30 last year.

He had been the victim of a hit and run after he was allegedly struck by a vehicle walking home from a pizza shop the night before.

Police launched an investigation into Mr Mitchell's death and, two days later, a 29-year-old Kingsthorpe man Tyrone Desmond Owen Mason handed himself in to Toowoomba police.

He was charged with failing to make reasonable endeavours to obtain medical aid (to a person injured in a traffic incident) and showing callous disregard arising from the incident.

Mr Mason had been due to stand trial in the Dalby Magistrates Court on Friday when police prosecutors told the court they could be offering no evidence, according to 7 News.

Mr Mitchell's family spoke of their anguish outside court where his long-time partner Michelle Whale said they had been left angry.

"Where is the justice for Bruce?" Ms Whale told 7 News.

"It's not to us, it's not fair to the kids."
