Fleeing cops by car and on foot lands city man in jail

DRIVING away from police who pulled him over has left a Toowoomba man languishing behind bars.

Dean Edward Charles Cubby had been driving with a couple of passengers when a police patrol spotted his silver Commodore at the corner of James and West Sts in Toowoomba about 11.50am, March 30.

The motorcycle police officer activated lights and hand gestured to the 27-year-old to pull over which he eventually did on James St outside the Police Citizens Youth Club, Toowoomba Magistrates Court heard.

However, while talking to him at the side of the road, the officer noticed Cubby appeared on edge and repeatedly looking into his rear view mirror.

When another police car pulled up behind his car, Cubby accelerated away, police prosecutor Natalie Bugden told the court.

When the patrol car went to follow him, the motorcycle cop gestured not to as he had identified the driver.

Three weeks later, another police patrol spotted Cubby in the back seat of a car pulled over at the corner of Duggan and Little Sts about 3.15pm, April 21, Senior Constable Bugden said.

As police spoke with the driver, Cubby had alighted from the back seat and run off, ignoring police calls of "Stop running, this is the police", she said.

A foot chase through the CBD ensued until the 27-year-old was tackled and handcuffed on Margaret St.

Cubby appeared by video link from the prison where he has since been serving out a parole period to plead guilty to charges of failing to stop on police direction and two counts of obstructing police.

His solicitor Claire Graham told the court her client had developed a drug problem after breaking up with his partner 18 months ago which had led to his offending.

Ms Graham said her client had a full-time release date of September 3 and asked for a sentence that did not disturb that.

Magistrate Damian Carroll sentenced Cubby to the mandatory 50 days for failing to stop, with a parole eligibility date of July 7, and disqualified him from driving for two years.
