Fined for watching mate smoke marijuana

A 35-YEAR-OLD man who watched his friend smoke marijuana at a Hervey Bay home has been fined $750.

David Smith, of Urraween, pleaded guilty in Hervey Bay Magistrates Court to possessing dangerous drugs and possessing utensils related to drugs.

Police prosecutor Senior Constable Donna Sperling said police went to the home after a noise complaint at about 8.40pm on July 22.

She said while they were there, police saw three men, including Smith sitting around a table with a water pipe and a small amount of cannabis.

Police saw one of the men smoke the cannabis.

Defence lawyer Justin Geldard said Smith had only recently arrived at the home and the home's owner had been smoking cannabis.

"There is no allegation he was actually using the drugs," he said.

Magistrate Graeme Tatnell warned Smith if another person was using drugs, he should leave.

The man was fined $750.
