Motorist adamant he swerved to dodge a cow

A MOTORIST who claimed he swerved to dodge a cow on the Capricorn Highway before running off the road was fined $800 in Rockhampton Magistrates Court on February 1.

The court heard Ignatius Marthinus Hartzenberg was travelling home to Stanwell at 12.50pm on September 12 when witnesses reported seeing his Nissan Patrol swerve onto the wrong side of the highway.

Police prosecutor Clancy Fox said other motorists had to swerve to avoid a head-on collision before Hartzenberg's car left the road and travelled 60m before coming to a rest.

Mr Fox said Hartzenberg later told police he was taking evasive action to avoid a large cow which wandered onto the road five metres in front of his vehicle.

"He is adamant he saw a beast on the road and swerved to miss it," a defence lawyer said.

The 38-year-old pleaded guilty to one count of driving without due care and attention.
