Ooralea Developments: planning scheme “grossly inadequate"

A DEVELOPER has dubbed Mackay's planning scheme "grossly inadequate" in legal proceedings after the Mackay Regional Council rejected its proposed subdivision.

Company Ooralea Developments applied to subdivide a rural lot on Schmidtkes Road, Ooralea into 101 subdivisions in May 2014.

The council rejected the proposal and the company halved the proposed subdivisions to involve 58 lots.

In November 2014 the council refused the second application, questioning the need for a residential development in Ooralea.

The council said Ooralea Developments had not proved the subdivision was needed "to accommodate the future residential growth for Mackay".

The rejection also said the proposal conflicted with the "overall outcomes" of the Mackay Hinterland Locality Code as well as the rural zone code, the good quality agricultural land overlay code, the environment and infrastructure code, and the reconfiguration of a lot code.

In the documents, the company claimed the city's entire planning scheme was out of date.

"The current Mackay Planning Scheme is grossly inadequate having been conceived prior to the more recent development pressures and does not reflect contemporary planning theory," they submitted.

Ooralea Developments claims the council's "overall outcomes" zoning concerns are not enough to refuse the proposal.

The developer pointed to the Mackay Isaac Whitsunday Regional Plan, which identified Ooralea as an expansion suburb.

The developer said the MIWRP had noted "one of the challenges for Mackay is to 'increase residential development south of the river'", which it claims its subdivision would provide.

Ooralea Developments appealed the decision to the Brisbane Planning and Environment Court where it was briefly mentioned on Wednesday.

The matter was adjourned for a month.
